74-year-old German gets 81 years jail term for defilement and child pornography charges

A 74 year old German man who was charged with several offences related to defilement and child pornography has been sentenced to serve 81 year in jail by a Nairobi court.

Principal Magistrate Thomas Scheller was found guilty of seven counts related to the sexual offences act.

Njagi sentenced him to 30 years for the first count of defilement, then 15 years each for count two and three then 7 years for the other counts.

The court further ruled that having been convicted and sentenced for the offences then Scheller will now be entered into the sexual offender’s record.

“The accused having been convicted and sentenced, he will be entered into the Sexual offenders record “, the magistrate ruled.

He was arrested in 2020 and charged with the said offences but the court denied him bail and he has been in custody during trial.

The prosecution alleged that between March and April at Nyalenda in Kisumu Central, he defiled a 13-year-old child.  

It was further alleged that he showed pornographic video to boys.

“On dates between the months of March and April at Nyalenda in Kisumu, he unlawfully and intentionally exposed a child aged 13 years to an indecent audiovisual,” the court said.

It was alleged that he recruited, transported and harboured a 13-year-old child for purposes of exploitation by means of fraud.

In his mitigation, the accused had alleged that he was framed and pleaded for lenient sentence.

According to Scheller, he told court he wanted to help the child and the mother agreed but anything else was a lie.
