The Milimani Anti-Corruption Court on Wednesday suspended former Murang’a Governor’s Mwangi Wa Iria wife’s Jane Waigwe Mwangi and her brother Solomon Mutura Kimani plea taking Sh 140 million graft case.
This is after the court was informed that there were orders issued by a Muranga high court stopping their prosecution.
Through lawyer Ndegwa Njiru told court that the High Court sitting at Murang’a had issued orders revoking any decision by the ODPP to charge or prosecute them.
Njiru said the orders by the High Court stays the decision by the ODPP to charge or prosecute Mwangi Wa Iria, his wife and the other co-accused persons.
Magistrate Thomas Nzioki discharged the two saying the high court was a superior court.
“This court remains bound by the orders of the superior Court. The taking of plea in his case is hereby differed pending the determination of a case filed at Murang’a,” the court ruled.
Wa Iria moved to court yesterday and sought orders barring their arrest and prosecution.
In the orders, the High Court Judge ruled that the ODPP, EACC and the Inspector General of Police should not arrest and or charge the accused persons pending the hearing and determination of the case filed before the Court by Wa Iria challenging his arrest and prosecution over the case.
