A city businessman who is alleged to have caused the death on a Military officer during an altercation at a bar last month will now be charged with murder after the DPP approved the charge.
Ian Rotich is alleged to have hit officer Kelvin Waweru with a stone during an altercation outside city bar which gave him injuries which later caused his death.
Rotich was arraigned before a Nairobi court for murder but he did not take plea as the court ordered for a mental assessment to be done on him before he takes plea.
Rotich is represented by Lawyer Danstan Omari who did not oppose the directions for mental assessment on him.
According to court records, it is alleged that Rotich was in the company of three others leaving one club going to another club when the alleged altercation happened.
One of the guys with in Rotich car saw a lady walking with the deceased both looked drunk and he claimed that was his girlfriend.
He alighted from the car and went to take the girl to take her to the car but Rotich joined him and a fight ensued between him and the Military man.
He allegedly took a stone and used to hit the officer then they drove off and left him there.
He was later rushed to hospital where he succumbed to the injuries days later
