City Lawyer Danstan Omari will move to court to challenge the sacking of Nyamira Health CEC Timothy Ombati.
Ombati was sacked by Governor Amos Nyaribo over allegations of drug theft and misappropriation of public funds.
However, Omari says his client was illegally sacked and they will fight it in court to reclaim his job.
“He has been sacked unprocedurally, there is no money lost and he is not the accounting officer he is only a victim of clannism,” Omari said.
In the letter of termination, the governor claims on July 13 while commissioning the distribution of drugs, Ombati lied to him that he had delivered the consignments to the entire county when he had not.
Nyaribo says that he had ordered that the consignment was for the entire county and not for some parts of the county.
Documents exclusively in possession of Court Helicopter state that the suppliers of the drugs had since apologised twice to the county and owned up that the delay was occasioned by the Azimio maandamano since Nyamira was the epicentre of violent demonstration thus exonerating Ombati from blame.
But Nyaribo claims that Ombati was dishonest therefore he breached the trust bestowed upon him as a senior government official.
“Your services with the County government of Nyamira as a County Executive Member are hereby terminated and you shall stand dismissed from service with effect from the date of this letter,” the letter reads in part.
