A constitutional case filed against late Former IEBC Chair Wafula Chebukati will proceed despite his death after court gave directions without removing his name.
In the case, activist Khalef Khalifa sued Chebukati, Azimio leader Raila Odinga, and Wiper leader Kalonzo Musyoka in matters relating to the last general elections and alleged irregularities surrounding the poll process.
When the cases was mentioned today before High Court Judge Lawrence Mugambi, the lawyer representing Chebukati told court that he had no instructions on how to proceed, given that his client is now deceased.
“I have not filed responses because the respondent is now deceased, and we are yet to receive instructions on how to proceed,” the court was told.
Additionally, the court heard that the petitioner was supposed to file responses to an application related to the case.
The court directed all parties to file their responses and submissions and scheduled the matter for mention on July 1 to set a ruling date.
