Deputy President Rigathi Gachagua has suffered a setback yet again after the high court for the second time declined to issue orders stopping his impeachment tomorrow.
“This court has noted there are several other matters touching on the same issues . I find merit in placing it before the Presiding Judge who will give directions on this and possibly any other of similar nature. For now this court declines to issue conservatory orders at this stage,” said Mwamuye.
In the case, Former Senator Cleophas Malala had filed the case last week seeking for orders but the court declined and today morning they made a second attempt to get orders but the judge declined.
Justice Bahati Mwamuye however directed the matter to be placed before the Presiding Judge Chacha Mwita for further directions.
The National Assembly and the Senate told court that there are over 18 matters filed in various courts within the country touching on the DPs impeachment.
Lawyer Paul Nyamodi requested the judge to refer the matter to the Presiding judge so that he can consider which judge the file will be allocated to.
