Court Dismisses Petition Seeking Release of Alleged Kenyan Police Abductees

The High court on Thursday dismissed case which sought to compel the state to release people who were alleged to have been abducted by the police ruling that there is no evidence to show that the said individuals are in police custody.

Justice Bahati Mwamuye, ruled that the applicants failed to provide sufficient evidence showing that the missing persons were in the custody of the respondents further noting that the applicants did not adequately substantiate their claims.

They did not establish that the seven individuals are in the custody of the respondents, nor did they satisfy the court that the seven, along with an eighth individual, are being illegally detained by either known or unknown persons,” the court observed.
