Court lifts warrant of arrest against couple accused of forging late tycoon father’s will.

A Nairobi court on Tuesday lifted warrants of arrests that had been issued against a couple accused of forging late tycoon father’s will.

Dinta Devani Pathania and Abhay Singh Pathania appeared before Chief Magistrate Benard Ochoi to lift the warrant.

Through their lawyer Danstan Omari, the couple made an application to lift the order saying they didn’t intentionally fail to come take plea as they were not aware the matter was coming up.

In his ruling, Ochoi said that the explanation given for the failure of the accused persons to appear in court indicated that on the date for plea taking they were not aware that the matter was coming up for plea and that they only learnt of the same through the social media.

The prosecution did not object to the lifting of the warrant of arrest.

The court directed that they appear before the DCI for processing as soon as possible.

They were directed to appear in court on May 6 when the case is scheduled for mention for plea taking.

They were released on a cash bail of 100,000 each pending the plea taking.

The two Indians alongside Samuel Ngugi and Addah Nduta were supposed to appear in court over forgery.

According to the charge sheet, the four on June 5, 2019 forged the codicil will of Balkrishna Ramji Haribhai Devani in contravention of Section 393 of the Penal Code.

The four are also accused of intermeddling the estate of the late Balkrishna Ramji Haribhai Devani by transferring the shares of Pelikan Signs Ltd without express authority.

They are also accused of conspiring to defeat Justice by filling supporting affidavit in Nairobi High Court succession case of the estate of Balkrishna Ramji Haribhai Devani.
