Ex-Mungiki leader Maina Njenga who was charged on Monday with preparing to commit a felony has been released on a Sh 100,000 bail.
Njenga who was arrested last week, had been charged alongside his brother Peter Kamunya and a Felix Lakishe who were also granted the same bail terms.
Makadara Chief Magistrate Francis Kyambia on Tuesday ruled that had the accused had constitutional rights to be granted bail pending trial.
Kyambia further ruled that the prosecution had not given any evidence to prove that the three would interfere with witnesses.
They were also charged with two other counts of being in possession of narcotics and intent to incite the public to violence.
According to the charge sheet, they were found with cannabis weighing 1.224 grams of a market value of Ksh.36,720 and cocaine weighing 486 grams of a market value of Ksh.1.944. 000 concealed in plastic bag packages in motor vehicle make Toyota Hilux Surf registration number KCJ 413X.
The prosecution also claimed that on the same day, they were also found with 14 machetes, 24 Maasai swords, 46 rungus and three jembe sticks in circumstances which raised a reasonable presumption that the weapons were intended to be used in prejudicial to public order.
It was also alleged that they jointly organized an unlawful assembly and procession scheduled to take place within Nairobi and other parts of the country.
The case will be heard on December 4.
