The Energy and Petroleum Regulation Authority (EPRA) boss Daniel Kiptoo has been summoned to show cause why he should not be held in contempt for implementing fuel levy.
A three-judge bench on Monday issued summons to Kiptoo directing him to appear in court and explain why he increased petroleum prices by 8% even after the court suspended the Finance Act 2023.
In the case, Busia Senator Okiya Omtatah has challenged the implementation of the act saying its unconstitutional.
Justice Mugure Thande issued orders suspending the implementation of the fuel levy that is within the impugned Act.
However, the state reviewed the fuel prices even though there was a court order barring them from implementing the Finance Act.
In his contempt application, Omtatah argued that EPRA was duly served with the order but he disobeyed.
