The DPP was on Thursday forced to drop CS Peter Munya as a witness after court declined to adjourn the hearing.
Munya who had been summoned through a warrant of arrest after he failed to appear in court to testify against his former colleague former CS Henry Rotich.
However, when he took the stand before trial magistrate Eunice Nyutu, the prosecution said they were not ready to proceed and asked for an adjournment.
Nyutu declined to adjourn the matter forcing the prosecution to drop Munya as a witness.
The court further warned anyone trying to interfere with the case including not producing witnesses.
The court also said it not resist to exercise it’s powers and cite parties for contempt of court if that happens.
In the case, former Treasury CS Henry Rotich has been charged alongside six others with conspiracy to defraud Sh63 billion in the Arror and Kimwarer dams case.
