The KERRA employee who claimed that the Sh 21 M frozen in his account by EACC was to pay dowry has now pleaded with court to release it so that he can marry his fiancée.
In his submissions to court, Daniel Wambua through lawyer Danstan Omari told court that his expected wife can’t enter his house customarily before he pays dowry for her.
Omari told Justice Nixon Sifuna that the EACC had overstepped their mandate by investigating dowry issues.
“My Lord I urge you to set aside the orders freezing his accounts so that he can go get married,” Omari said.
He claimed that due to his popularity, Wambua had gotten enemies who might be using EACC to frustrate Wambua’s marriage.
Omari urged court to unfreeze the money so that his client could go and get pay dowry as is expected customarily.
He further claimed that due to Kamba customs Wambua’s fiancée cannot enter the house until dowry is paid.
Omari also said the investigations had led to his client being interdicted from work pending conclusion of the cases.
He said over 900 family and friends had contributed the money and seven of them had already sworn affidavits confirming that they were indeed part of the dowry.
However, in response, the EACC maintained that the money was from proceeds of crime and they were still investigating him.
They told court that they did not believe the dowry story that has been brought by Wambua saying that was not true.
The judge will deliver ruling in the case on November 9.
