Former news anchor Jacque Maribe and Joseph Irungu alias Jowie’s murder judgement has been adjourned yet again.
This is after the court was informed that Maribe was unwell thus was not present in court.
Jowie was the only one present in court as Maribe was said to be indisposed.
Through her lawyer Katwa Kigen, Maribe said she was unwell and would not be able to appear in court for delivery of the judgement.
He said the family of Maribe was in court including her mother,father and sister.
Katwa says the nature of indisposition is confidential and they were seeking for the courts indulgence.
“She is prepared to participate virtually if that is facilitated She expected to be well within seven days and if a date is issued she will be available,” Katwa said
He also said Maribe has never been absent from court this is the first time and she apologizes to the court and other parties for the inconvenience.
Jowie’s lawyer did not object to the application saying they were willing to indulge her.
Monica’s family lawyer said Sickness does not notify and so they were willing to indulge her.
He also noted that the victims family has been anxious to know the outcome of the judgement.
The prosecution did not oppose the application but asked the court to direct her to present the documents to support that she was unwell.
“We have heard what he has said as a state we were ready to take judgement and we prefer it to be physical and she should tender documents to support her sickness claim,” the state said.
In her directions, Justice Grace Nzioka allowed the application for adjournment due to sickness.
She said this is because there are no serious objections raised by the other parties including the state noting that they were willing to accommodate Maribe.
Judge Nzioka further reiterated that the judgement was ready and she was ready to read it but would adjourn to allow Maribe be present.
The judgement will be delivered on March 15.
