Matatu Operators Now Want NTSA Director Jailed for Refusing to Release Vehicles.

Several Matatu operators who are owners of Nganya’s in the city that have been impounded by NTSA have moved to court seeking to commit Director of Road Safety Andrew Kolkata to civil jail.

Through lawyer Danstan Omari, the operators have filed contempt proceedings against NTSA arguing that they have refused to release the vehicles to them as had been ordered by court.

Justice Bahati Mwamuye had issued conservatory orders dated and delivered on February 32025, in light of the Petitioners’Application and Petition dated the January 28 2025, directing the 1st and 2nd Respondents to release the vehicles and registration number plates impounded and plucked off their Matatus with immediate effect.

However, Omari says that even after taking his clients to NTSA, they vehemently opposed to the release of the vehicles.

February 4 2025, at around 11am, the operators made their way to NTSA offices in the company of their Counsels on record to collect their registration number plates as per the Court Order, but were met with a rude shock as NTSA was adamant to meet them or effect the directions of the Honorable Judge

Omari further says that in spite of the timely service of the Court Order and considerably lengthy duration allowed to effect the orders, blatantly opted to despise the directions of the Honourable Court, by keeping the Petitioners and their Advocates waiting for the said registration number plates for over three hours, in vain.

They want Kiplagat to show cause why he should not be cited for contempt of His Lordship Justice Bahati Mwamuye’s orders dated the February 3 2025, directing the 1st and 2nd Respondents to release to the Petitioners all vehicles and registration number plates of vehicles impounded by the 1st and 2nd Respondents, to the Petitioners herein.

May the court be pleased to sentence the Director Road Safety, one Dr. Andrew Kolkata, to 6 months imprisonment in civil jail, for contempt of this Honourable Court’s orders dated 3rd February 2025 as issued by His Lordship Justice Bahati Mwamuye on the said date,”
