The Attorney General and the National Assembly have urged the bench handling DP Rigathi Gachagua’s impeachment case not to recuse themselves from case as has been requested.
Senior Counsel Githu Muigai for the AG said it was unfortunate that the lawyers for Gachagua were asking the court to recuse themselves only because they were not getting their way.
Githu asked the court not to give in to their application saying by so doing then it would give a bad precedent because lawyers would be coming to court to ask for recusal because people go to the same church or mosque.
Githu questioned Judge Eric Ogola being close to his wife be a bad thing adding that a professional person is entitled to an independent professional existence
“Paul Muite came to my wedding and brought be a copper coffee dispenser. Am I never to do any case with him? Three quarters of the lawyers under the age of 50 I have taught them, should I also recuse myself each time I appear against them?” Githu posed.
According to the former AG, this complaint about the bench is founded on the fact that the AG, for the first time, also got orders to expedite the hearing that it is when this bench became bad.
“It was a very good bench for as long as it gave any order in favor of the petitioners,” he added.
Lawyer Eric Gumbo for the National Assembly on his part said the lawyers calling for the recusal were not being truthful as some of their accusation on the judges were not true.
