A three judge has now paved way for the swearing in of DP elect Kindiki Kithure after setting aside the order that had stopped him from assuming office.
This is a blow to impeached DP Rigathi Gachagua who had secured the orders stopping the swearing in ceremony.
The court ruled that the current constitutional framework does not envision any scenario in which the office of the DP would remain vacant except during the brief period required to fill a vacancy
“Public interest demands that the office of the deputy president should not remain vacant” the court ruled.
However, Gachagua has asked for a stay of the ruling saying Kindiki is not suitable to hold that office.
They asked for a stay of the ruling pending filing of their appeal at the court of appeal.
