Two judges of the Supreme Court Deputy Chief Justice Philomena Mwilu and Justice Mohammed Ibrahim have won the first round in their legal battle in relation to their removal from office.
Justice Bahati Mwamuye directed that the two cases which are challenging the hearings at the Judicial Service Commission, be forwarded to the Chief Justice Martha Koome to empanel a bench to hear it.
The Chief Justice will now appoint a panel of judges to hear and determine the matters but interestingly, Koome also has a similar case before a different court that is seeking for empanelment of a bench so it’s not clear if she will also empanel a bench for her matter if the court allows it.
Justice Mwamuye said the high court is the proper forum to hear the two petitions adding that the petitions are not an abuse of court process.
