A Milimani court has ordered the OCS Industrial area police station to return Embakasi East MP Babu Owino’s phone back to him.
This is after his lawyers Danstan Omari and Duncan Okatch told court that the legislator had not been able to communicate without that phone.
Omari said that the phone Babu uses to conduct parliament business and because of its confiscation, he was not keeping up with communication that concerns delivery of his mandate.
Senior Principal Magistrate Esther Kimilu said the phones should be released to Babu and his co accused once investigations are complete.
Similarly, the court also directed Calvin Gaucho to file a complaint of assault at any police station within the jurisdiction of Kilimani area.
This is after lawyer Okatch told court that they had reported the assault to Kileleshwa police station but the police had refused to take their report.
Gaucho had climes that the investigating officer in the matter had slapped him during his arrest.
Babu, Gaucho and five other were last week charged with conspiring to plan and organize demonstrations.
They were released on a Sh 100,000 cash bail each pending hearing of the case.
The case will be mentioned next week to confirm compliance of the court’s directions.
